Federal Court Upholds EPA PFAS Listing; No Change for Fluorinated Packaging
On August 18, 2026, a federal appeals court in Washington, D.C. ruled that EPA followed the right process in 2024 when it added two PFAS chemicals, PFOA and PFOS, to the hazardous substances list under CERCLA, the federal Superfund cleanup law. That is what the court decided.
The ruling does not address container fluorination. The case concerned EPA's process for adding the two chemicals to the list. Inhance Technologies was not a party to the case, and the court made no findings about fluorination or fluorinated containers.
The rule is not new. EPA finalized it in April 2024 and it took effect in July 2024. All the court did was leave that rule in place. Nothing about the rule changed.
Inhance Technologies operations continue as normal. Customer supply is unaffected.
