On August 18, 2026, a federal appeals court in Washington, D.C. ruled that EPA followed the right process in 2024 when it added two PFAS chemicals, PFOA and PFOS, to the hazardous substances list under CERCLA, the federal Superfund cleanup law. The case concerned EPA's process for adding the two chemicals to the list. Inhance Technologies was not a party to the case, and the court made no findings about fluorination or fluorinated containers. The rule is not new. EPA finalized it in April 2024, and it took effect in July 2024. All the court did was leave that rule in place. Nothing about the rule changed.
There is no federal regulation restricting the use of fluorinated packaging, and no proposed rule. Any future rulemaking would require a full public notice-and-comment process taking years, and rulemakings of this kind have historically taken a whole-chemical approach rather than targeting individual applications.
